We understand that privacy is especially important when dealing with health, safety, and location data. We've designed our Service with privacy at its core—we only collect what's necessary and never engage in always-on tracking.

2. Information We Collect

2.1 Information You Provide

When you create an account and use EverWhen, you provide:

  • Account Information: Name, email address, phone number, date of birth
  • Health & Care Plan Data: Medication schedules and adherence records (whether a dose was marked as taken), blood glucose readings you choose to log, appointment reminders, and custom reminders
  • Helper Contacts: Names and contact information of trusted helpers you designate
  • Payment Information: Credit card details (processed securely through third-party payment processors)

2.2 Information Automatically Collected

  • Device Information: Device type, operating system, unique device identifiers
  • Usage Data: Check-in timestamps, interaction with notifications, feature usage
  • Location Data: When you enable location sharing, your device location is recorded periodically in the background (about every 15 minutes) so a recent location is available if you miss a check-in. Your helpers only see it during an active incident (see Section 4).
  • Call Data: Records of automated wellness and safety calls, including call duration and whether the call was answered. Where permitted by applicable law and with appropriate notice to the people on the call, calls may be recorded and converted to a written transcript using automated (AI) services so we can determine whether you are safe and improve call quality.

2.3 Information from Third Parties

We may receive information from:

  • Authentication providers (e.g., Apple Sign-In, Google Sign-In)
  • Payment processors for transaction verification
  • Analytics providers to improve our Service

3. How We Use Your Information

We use the information we collect to:

  • Provide Our Service: Send check-in notifications, reminders, and wellness calls
  • Safety Features: Contact helpers during incidents, coordinate emergency responses
  • Improve Our Service: Analyze usage patterns, fix bugs, develop new features
  • Customer Support: Respond to your inquiries and provide assistance
  • Billing: Process payments and send billing notifications
  • Legal Compliance: Comply with applicable laws and regulations
  • Security: Detect and prevent fraud, abuse, and security incidents

4. Location Data and Privacy-First Approach

Location sharing is off by default. You choose whether to turn it on, and you can turn it off at any time.

When you enable location sharing in your safety settings, EverWhen records your device's location periodically—approximately every 15 minutes, including while the app runs in the background—so that a recent location is available if you miss a check-in or an incident is opened. This requires granting the app background (“Always”) location permission, and your device displays an indicator while location is being shared.

Your helpers can only see your location during an active incident—for example, when you have missed a check-in and an escalation is in progress. They do not see your location during your normal day.

You can stop location collection at any time by turning off location sharing in the app, or by revoking location permission in your device settings. We never sell your location data.

5. Information Sharing and Disclosure

We share your information only in the following circumstances:

5.1 With Your Helpers

Information shared with designated helpers depends on the permissions you grant:

  • Viewer Permission: Can see check-in status and receive incident notifications
  • Editor Permission: Can also manage your care plan and reminders
  • During Incidents: Helpers receive notifications and may see your location if you've granted permission

5.2 With Service Providers

We work with trusted third-party companies to help operate our Service:

  • Cloud hosting, database, and backend infrastructure
  • Authentication and account security
  • SMS and automated voice-call delivery
  • Automated (AI) wellness-call services, which may process call audio and transcripts through voice and language-model providers solely to operate the call
  • Subscription and payment processing (including the Apple App Store, Google Play, and our payment processor)
  • Error monitoring and aggregate usage analytics

These providers are contractually bound to protect your information and use it only for the purposes we specify. We maintain a current list of the specific service providers (sub-processors) we use and will provide it on request at the contact address below.

5.3 Legal Requirements

We may disclose your information if required to do so by law or in response to:

  • Valid legal processes (subpoenas, court orders)
  • Requests from law enforcement or government agencies
  • Protection of our rights, property, or safety
  • Emergency situations involving danger of death or serious physical injury

5.4 Business Transfers

If EverWhen is involved in a merger, acquisition, or sale of assets, your information may be transferred. We will notify you via email and/or prominent notice on our Service of any such change.

We implement industry-standard security measures to protect your information:

However, no method of transmission over the internet is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

We retain your information for as long as necessary to provide our Service and fulfill the purposes outlined in this policy:

  • Active Accounts: Data is retained while your account is active
  • Deleted Accounts: Most data is deleted within 30 days, but some information may be retained for legal compliance (e.g., billing records)
  • Incident Records: Retained for 90 days for safety and support purposes
  • Analytics Data: Aggregated, anonymized data may be retained indefinitely

8. Your Privacy Rights

Depending on your location, you may have the following rights:

  • Access: Request a copy of your personal information
  • Correction: Update or correct inaccurate information
  • Deletion: Request deletion of your account and data by emailing us at the address below, or through the in-app account deletion option where available
  • Portability: Receive your data in a machine-readable format

  • Object: Object to certain processing activities

EverWhen is designed for adults. It is not intended for, and we do not knowingly collect personal information from, anyone under the age of 18. If we become aware that we have collected data from a minor, we will take steps to delete it promptly.

Your information may be transferred to and processed in countries other than your country of residence. We ensure appropriate safeguards are in place to protect your information in accordance with this Privacy Policy and applicable laws.

11. California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to know what personal information is collected
  • Right to know if personal information is sold or disclosed
  • Right to opt-out of the sale of personal information (we do not sell your data)
  • Right to deletion
  • Right to non-discrimination for exercising CCPA rights

12. European Privacy Rights (GDPR)

If you are in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR). We process your data based on:

  • Contract: To provide the Service you've subscribed to
  • Consent: For location sharing during incidents
  • Legitimate Interests: To improve our Service and prevent fraud

14. SMS Opt-In Data

Notwithstanding any other provision in this Privacy Policy, SMS opt-in data and consent will not be shared with any third parties for marketing or promotional purposes.

Your phone number is used exclusively for the safety and wellness features of EverWhen—such as check-in notifications and wellness calls—as described in our Terms of Service. We do not sell or rent your mobile phone number to third-party marketers.
